Buying, inheriting or receiving property is only half the story - until the government's land records show your name, you are not the recorded owner. That updating of records is called namantaran (नामांतरण), or mutation. In Madhya Pradesh it is handled through the revenue department, and the paperwork differs depending on how you acquired the property.
There are nine recognised case types. Picking the right one matters, because each has its own document requirements.
1. Registered sale deed (पंजीकृत विक्रयपत्र के आधार पर)
The most common case - you bought the property and hold a registered sale deed. Mutation transfers the record from seller to buyer. You need the registered deed and identity documents of the parties.
2–3. Succession (फौती नामांतरण)
When a recorded owner passes away, the record moves to the legal heirs. MP distinguishes two situations: succession where some heirs waive their rights in favour of others (हक त्याग), and succession where all heirs take their shares. Both need the death certificate and heir details; the waiver route additionally needs the relinquishment documentation.
4. Other modes of acquiring rights (अन्य प्रकार से हक अर्जन)
A catch-all for lawful acquisitions that don't fit the named categories - for example rights recognised through settlement or long-standing possession supported by documents.
5. Minor attaining majority (नाबालिग से बालिग)
Property recorded in a minor's name through a guardian is re-recorded in the owner's own name when they turn eighteen. Age proof does the heavy lifting here.
6. Civil court decree (व्यवहार न्यायालय के डिक्री)
If a court has decided ownership - a partition suit, a title dispute - the decree itself becomes the basis for mutation. The certified copy of the decree is the key document.
7–8. Land exchange and gift deeds (भूमिविनिमय / दान पत्र)
Registered exchange deeds (two parties swapping land) and registered gift deeds (transfer without consideration, typically within families) each have their own mutation category. In both cases the registered deed is mandatory - unregistered family arrangements do not qualify.
9. Succession by will (वसीयत के आधार पर)
Where the deceased left a will, mutation follows the will rather than default succession rules. Expect closer scrutiny: the will, the death certificate and heir details are all required, and objections from other heirs are handled during the process.
What it costs and how long it takes
Because the case types differ so much, pricing is quoted per case. Timelines depend on the tehsil office and whether objections are raised. The practical advice: get every party's Aadhaar, the underlying deed or certificate, and - for succession cases - the death certificate ready before you start. Missing documents are the main reason mutations stall.
