Registration and mutation are not the same thing. Registering a sale deed records the transaction; namantaran updates the revenue record so the land itself is shown in the new owner's name. Skipping mutation leaves the record pointing at the previous owner, which surfaces later as a blocked sale, a refused loan, or a tax demand to the wrong person.
Madhya Pradesh recognises several distinct mutation cases, and the paperwork is different for each. Below is what each one turns on.
1. Sale deed (विक्रय पत्र)
- The registered sale deed, with the registration endorsement.
- Identity documents of buyer and seller.
- Previous ownership record and current khasra/khatauni extract.
- Proof that property tax and dues are cleared to date.
2. Succession - all heirs (वारिस नामांतरण)
Where all heirs are being recorded together, the case is comparatively straightforward. The names and shares must be complete - omitting an heir is not a shortcut and creates a defect that resurfaces at the next sale.
- Death certificate of the recorded owner.
- Legal heir certificate, or a succession certificate where required.
- Identity documents for every heir, and their relationship proof.
- Current revenue record extract.
3. Succession with waiver (हक त्याग)
This is the case most often attempted informally, and the one where informality causes the most trouble. A waiver that is not properly executed and registered may not hold.
- Everything required for an ordinary succession case.
- A registered relinquishment or waiver by the heirs giving up their share, executed properly rather than on plain paper.
4. Will (वसीयत)
Will-based mutation is the most contested category. Expect notice to interested parties and the possibility of objection, and expect it to take longer than a sale deed case.
- The will itself, and proof of the testator's death.
- Evidence establishing that this is the operative will.
- Identity documents of the beneficiaries.
5. Gift deed (दान पत्र)
- The registered gift deed.
- Identity and relationship documents for donor and donee.
- Current revenue record extract, and dues cleared.
6. Land exchange (भूमि विनिमय)
- The registered exchange deed covering both parcels.
- Records for both properties, not just the one you are gaining.
- Identity documents for both parties.
7. Court decree (न्यायालय आदेश)
- Certified copy of the decree or order.
- Confirmation that the decree is final and, where relevant, that appeal time has passed.
- Current record extract and identity documents.
8. Minor attaining majority (बालिग होना)
- Proof of date of birth for the person who has attained majority.
- The existing record showing guardianship.
- Identity documents.
9. Other acquisition
Acquisitions that do not fit the categories above - certain government allotments, partitions and transfers under specific schemes. These turn on the instrument that created the right, and the document set follows from it. Tell us how the property came to you and we will identify the case type.
What is common to all nine
Mutation is a public process. Notice is issued and objections are invited, which is a protection for genuine owners and the reason cases involving disputed succession take longer.
